Jollymap Explorer Membership Terms and Conditions

1. Application and membership registration

1. Applicants must be 18 years of age or older and fill in their personal information at www.jollymap.com to become a Jollymap explorer, enjoy member-only privileges and accumulate mileage points.
2. Each individual can only submit a Membership application for once and register for one Membership account.
3. Membership belongs only to the member, any transfer, lease, inherit or use for other purposes at any time is not allowed. Members shall be fully liable for the consequences arising from violation of this Article.
4. Jollymap Miles can only used by the Miles owner, cannot be transferred, assigned, collected or gifted to other Members/a third party and cannot be cashed out. 
5. Jollymap reserves the rights of final decision, including modify This membership, fees, various offers and other features, or suspending, terminating or changing details of The Membership and its terms and conditions without prior notice. Jollymap shall not be responsible in any manner for direct, indirect, special or consequential losses or damages.
6. Membership is permanently valid during your lifetime unless Member requests for withdrawal and submits application for withdrawal or upon occurrence of other events where the Membership should be terminated according to these Rules. 
7. You may not use the Membership Services if you do not agree with any terms, conditions and rules (include but not only “Privacy Policy”) or any part of them.
8. In general, Jollymap provide a 1-year warranty for the bike frame. This Limited Warranty does not cover: a) normal wear and tear (including, without limitation, wear and tear of tires, pedals or brakes); b) defects caused by rough handling (including, without limitation, defects caused by sharp items, by bending, compressing or dropping, etc.). Welcome to pick the bike to our stores and let our staff have a detailed check. If there are any needs for component replacement, we will provide or ask the supplier for quotation.

2. Jollymap Miles

1. To earn Jollymap miles, Members must quote their membership registered phone number and email before, when paying the bill or upon delivery of Partner products or services (as applicable). The consumption will be awarded 1mile per HK$1.
2. Members have no expiry date. The miles count at consumption date and are valid for two years, otherwise all remaining Jollymap miles will be forfeited thereafter. Miles cannot transit to other member account. Members can login and check Jollymap miles at www.jollymap.com.
3. The order state must be “Completed” while Members consume in store or online. Relevant Jollymap miles  will be credited to your account within at least 2 business days.If refund and change products, Jollymap will adjust the related miles within at least 5 business days. Please reserve the time for redemption. The update of earning miles depends on different activities, please refer to related activities pages for more details.
4. Members are required to present their registered phone number or email for the gifts redemption.
5. In order to earn Jollymap miles, you must be a Jollymap Explorer, and be logged on to www.jollymap.com to access the merchants’ websites via links on www.jollymap.com. Members cannot earn Jollymap miles for purchases that you make prior to logging onto
   www.jollymap.com.
6. Jollymap miles cannot be exchanged for cash.
7. All Jollymap miles required for redemption must be in the Member’s account at the time of redemption, and the pooling of Jollymap miles from a number of different Members’ accounts is not permitted.
8. Jollymap reserves the right to adjust or cancel any Jollymap miles credited to a Member’s account incorrectly, or not in accordance with, or in breach of, these terms and conditions or the terms and conditions of Partners, at any time, with or without notice to a Member.
9. Jollymap Explorer launches miles earning activities from time to time. The mile earning and redemption may be different from normal. The specific activities may apply additional terms and conditions in respect of the availability and eligibility of earning miles.From time to time, we may offer special promotional rates for award bookings. Such bookings will be subject to the terms and conditions published with each offer, which take precedence over these terms and conditions.

3. Gifts

1. All Jollymap miles required for redemption must be in the Member’s account at the time of redemption, and the pooling of Jollymap miles from a number of different Members’ accounts is not permitted.
2. All gifts are subject to availability and Jollymap may, at any time and without advance notice, withdraw, limit, modify, cancel or increase the availability of such gifts or to adjust the Jollymap miles required for redemption.
3. Gifts redeemed cannot be refunded or exchanged for cash, other gifts or services.
4. Jollymap is not responsible for the delivery service of gifts redeemed.
5. All redemption of gifts must be withdrawn and activities must be attended at the specific time. No redemption or refund of the mileage after the period.
6. Coupons redeemed cannot exchange for cash and reissue miles. Coupons will become invalid if not used within the validity period.Coupon redeemed will be subject to the terms and conditions published with each offer, which take precedence over these terms and conditions.
7. Gifts redeemed using Jollymap miles are not eligible to earn Jollymap miles.
8. Gifts may carry different validity periods, subject to gifts redeemed offers. The validity periods are based on Hong Kong time, unless expressly specific otherwise.
9. Playout Limited (Jollymap) is all right reserved.

4. Membership Termination

1. Jollymap may terminate the membership of a Member and the right of a Member  without notice if Jollymap believes that a Member commits Misconduct or Fraud, misuses Jollymap Explorer benefits and Awards, or fails to adhere to these Terms and Conditions. In such circumstances, Jollymap shall simultaneously cancel all Jollymap miles and/or Awards (as applicable) of the Member.
2. Any Member may apply to terminate his/her Membership via Jollymap Website at any time. Upon receipt of your termination request, we will verify your identity, log out your Membership account upon successful verification, and upon your request, remove your personal data from the systems involved in the implementation of our day-to-day business functions such that it can be kept in an irretrievable and inaccessible manner. At the same time, we reserve the right to keep a backup of relevant information and records in the back-end system in accordance with the requirements of applicable laws and regulations, which may include your personal data.
3. Once Membership is terminated, all accumulated spending amount, Jollymap Explorer coupons as well as other rights and privileges pertaining to such Membership will immediately expire and be invalidated with effect from the date of termination, and aforesaid rights and privileges will not be restored even if the Member reapplies for Membership.
4. Jollymap reserves the right of final decision in case of any disputes regarding termination of Membership.

5. Language

This terms and conditions has been translated into Traditional and Simplified Chinese. If there is any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.

6. Indemnify of Damages and Limitation of Liability

1. You agree to indemnify and hold harmless Jollymap and member entities in its group, and members, management, directors, employees, agents, licensees and suppliers of the aforesaid companies (collectively referred as “Designated Third Party(ies)”) against any claims, losses, liabilities, expenses or damages arising out of or in connection with your behaviours, your breach of these Rules, your illegal acts or your infringement or aiding and abetting in infringement of rights of adidas, its group companies and the Designated Third Party(ies).
2. Unless otherwise explicitly provided under law and to the maximum extent permitted by the applicable law,Jolly shall not be liable for any indirect, incidental, special, punitive, penalized or consequential damages in whatever form, no matter how the damages may occur, and whether arising out of tort, breach of contract or otherwise.
3. To the maximum extent permitted by applicable laws, adidas declares that it has made no representations or warranties, no matter in what form, whether expressed or implied, (except for any warranty under applicable laws applicable to consumers that cannot be legally excluded), but this Article would not affect your rights as a consumer under the law.
4. Jollymap shall not be liable for any damages or losses to any Members in the absence of clear evidence proving intentional misconduct or gross negligence of Jollymap.
5. To the largest extent permitted by applicable law,Jollymap will not be liable for any claims, requests, liabilities or litigation caused by or arising from the omissions, negligence and/or failure to provide us with the latest information by customer or Member, or the accuracy or completeness of such information.

7. Applicable Law and Jurisdiction

1. These Rules and the transactions relating to these Rules are governed by the Hong Kong law, and shall be interpreted in accordance with the laws of Hong Kong.
2. Any dispute or controversy arising out of or in connection with these Rules shall be settled by amicable and faithful negotiation between you and Jollymap to the extent possible. In the absence of gross negligence, Jollymap reserves the final right of decision on such dispute or controversy. If the negotiation fails, such disputes or controversy shall be submitted to the exclusive jurisdiction of a court with competent jurisdiction in Hong Kong.
3. If any provision of these Rules or any part in any provision of these Rules is determined as illegal, invalid or unenforceable, such provision or such part will be deemed to be severed from the other provisions or other parts in the relevant provision, the validity and enforceability of the remaining provisions of these Rules or the remaining part of the relevant provisions shall not be affected.

8. Third Party Rights

1. Subject to Article 8-2, no person shall have any right under the Contracts（Rights of Third Parties） Ordinance (Cap 623, Laws of Hong Kong) ("Rights of Third Parties Ordinance"） to enforce or enjoy the benefit of any of the provisions of these Rules.
2. The Designated Third Party defined in Article 6-2 of these Rules may rely on any provision of these Rules by the virtue of Rights of Third Parties Ordinance only if and to the extent that:(1) expressly such provision limits or excludes the liability of the Designated Third Party; or (2) such provision expressly confers on the Designated Third Party other rights or benefits (including but not limited to any indemnity).
3. Unless as otherwise expressly provided in these Rules, no right or benefit under any provision of these Rules enforceable under the Rights of Third Parties Ordinance shall be assigned by the Designated Third Party to another person.
